Fetal Homicide is a serious and tragic crime that is under-represented in the Massachusetts criminal code. Proposed Fetal Homicide legislation would add provisions to the Massachusetts criminal code that would create a separate category of criminal offenses causing injuries or the death of a "child in utero" at any time throughout pregnancy.
The proposed Massachusetts legislation is modeled after a federal statute, "The Unborn Victims of Violence Act of 2004," through which Congress has afforded legal protection throughout pregnancy to unborn children against crimes prohibited by the federal criminal code.
